Consignor Waiver

Consignor Agreement:

Program Overview: 

 Consignors earn 35% of their sold items. 

 Valet Consignor & Tagger will be paid directly by JBF Houston Northeast after the sale. Only UPFRONT costs includes $25 Valet Tagging Registration Fee.

 All Tagging Supplies (EXCEPT batteries) are provided by the Valet Tagger/JBF Houston Northeast. If items are left that require batteries, JBF has my permission to add batteries to the item so that it can be sold. I further understand that I will be charged a fee of $1.00 per battery for sizes AA and AAA and $2.00 per battery for sizes C and D.

 Valet Taggers are responsible for pricing.

 ALL items will be required to go half price.

 Consignors will have a $25 Valet Consignor/Supply Fee. The consignor fee covers up to 200 items. Items over 200 will result in an additional $5 per 50 items (rounded up). The additional consignor fees will be deducted from the consignor check if applicable. Consignors will have 2 options:

  1. DONATE all unsold items 
  2. PICK-UP all unsold items at Consignor pick-up after the sale

This choice must be made BEFORE the Valet Tagger accepts the items to tag. Valet Taggers will not pick-up Valet tagged items after the sale. Anything not picked up by the Consignor will be donated. No exceptions.

The Valet Tagger will be paid their percentage on all items tagged under the Valet consignor number they are provided. Consignors who wish to tag some of their own items will need to utilize their assigned consignor number.

Once the sale is over, the valet tagging agreement and percentage split is over. All items left in the valet tagging account are eligible for the consignor to make 60% at future sales (with some exceptions).

EXCEPTION:

If the consignor participates in JBF Houston Northeast Valet Tagging again, the same valet tagging account will be used. All items still remaining in the Valet Tagging account from before will become part of the new Valet Tagging sale percentage split. The Consignor will be responsible to drop-off previously tagged items from this Valet Tag account to the Tagger along with their current items needing to be tagged. The Valet Tagger will bring these items with the items they tag and put them out at the sale. (Consignors will not be charged on items previously tagged in the Valet account).

PROCESS IN DETAIL: 

1. Clean out your closets and play rooms and find all of those new or gently used items you’d like to sell. Make sure all items are in working order and free of stains, odors(smoke), pet hair, tears, etc.

2. Register with https://jbfsale.com/myjbfprofile/cpLogin.jsp and once logged in, click SIGN-UP next to the listing for Houston Northeast to participate in the current Fall sales event. 

3. Once you have completed this registration, you will be matched with one of our Valet Taggers. Once matched, please plan to cc: Amanda Henery ([email protected]) on all emails regarding Valet Tagging, including those between you and the Tagger.

4. Once you have been in contact with your Valet Tagger, schedule a drop-off time with her. Drop off can take place at the Valet Tagger’s home, or another mutually agreed upon location. 

5. Items will be inspected, prepped, and tagged by your Valet Tagger. Rejected items due to stains, odor(smoke), dirt/grime, rips/tears, excessive wear or any other defects will be charged as follows:

REJECTED ITEM INSPECTION FEES:

0-10 items rejected: $0

11-25 items rejected: $5 added fee;

26-50 items rejected: $10 added fee.

More than 50 items rejected will incur a $20 fee and will result in likely termination of the Valet Tagging agreement. These fees will come out of the consignor check at the end of the sale.

REJECTED ITEM RETURN OR DONATE: It is expected that the Valet Consignor will allow Valet Tagger or JBF Houston Northeast to donate or destroy any rejected item. If the Valet Consignor wants a rejected item returned to them, they must make the request BEFORE Consignor Drop-Off. The Consignor must e-mail their request to the Valet Tagger. It will be up to the Consignor to pick up the rejected item(s) at the Valet Tagger’s convenience. Any rejected item not picked up will be destroyed or donated.

6. All items will be entered into the JBF tagging system based on the Valet Tagger’s knowledge and expertise in pricing and JBF price guidelines. Per the Valet Tagging program, ALL items will be marked to go half price.

7. You will be notified when the Valet Tagger has inspected your items and entered the item descriptions/prices into the JBF tagging website. You may NOT change pricing/reduce/donate at this point as the barcodes have been printed for your tags.

8. Your Valet Tagger will hold and bring your items to consignor Drop-Off before the sale begins. Your Valet Tagger will check your Valet Tagging account into the sale and put your valet tagged items out on the sales floor. You will not need to come to Consignor Drop-off unless you are consigning other items from another JBF account.

9. You will be able to log-in to your Valet Tagging account at https://jbfsale.com/myjbfprofile/cpLogin.jsp and monitor your sales throughout the event.

10. If you had chosen to pick-up unsold items, you will need to come to Consignor pick-up at the designated date and time. If you chose to donate all unsold items, you do not have to come to consignor pick-up.

11. Wait for your check to arrive in the mail. Checks will be sent two weeks after the conclusion of the sale. Fees will be taken out of your consignor check if over 200 items + $5 each additional 50 items. Consignors who are valet tagged will earn 35% of their sales.

Quality Agreement:

I verify that no item I am consigning is the subject of any current, pending or threatened recall notice according to the Consumer Products Safety Commission.

Each item is clean, in good operating condition & is not defective, broken or damaged in any way. If any item is purchased and returned because it is defective, is missing parts or does not work, I will not be paid any amount for the sale of that item.  

I verify that I have inspected my items presented at drop off for sale in the JBF Houston Northeast Sale.  I understand that all my items presented at drop off are without stains, rips, pilling, excessive wear, smoke/pet odors, missing pieces & have working batteries. My items will be inspected by Valet Tagger for JBF quality & safety standards. Items not meeting JBF quality & safety standards will be removed from the sale floor and not available for purchase at the event.  

I verify that my items include all safety straps. Any item that requires safety straps that are not present may not be sold in the sale. Examples include infant items such as: high chairs, swings, mamaroo, ect.

Car Seats must have 1 full year of use left before expiration.  To sell a car seat at JBF Houston Northeast you must include waiver AND manual for each component. Find the car seat waiver HERE.

Cribs manufactured on or after June 28, 2011 may be sold with a required completed Crib Waiver. Download crib waiver HERE. All cribs MUST be assembled at the sale.

**Cribs made before June 28, 2011 are no longer considered safe for infants—that includes all drop side cribs as they pose significant risks to infants. They cannot be sold or donated.

I verify that my battery operated items have working batteries in place. A fee of $1.00 per battery will be charged if JBF Houston Northeast must supply batteries.

***Please carefully look over our NO THANK YOU list and familiarize yourself with items you should NOT bring to the sale. Dropping off these items will incur valet item fees.


Pre-paid Seller Fees are non-refundable (please reserve your Seller spot when you are certain about your plans to sell - this helps us plan for you).

I am the owner of and have carefully inspected the items that I am consigning.

I understand that there are risks associated with selling items in a public venue, and I have the option to place high value and/or high theft items in more secure locations. It is my responsibility to place my items in these secure areas during Drop Off (please inquire when you arrive).

I understand that JBF Houston Northeast is only a broker or agent for the Consignor. JBF Houston Northeast has no obligation to pay for unsold items. Title possession remains with the Consignor.

I understand that I will earn 35% of my gross sales tagged by a Valet Tagger, less a $25 VALET Consignor Fee for participation in the JBF Houston Northeast sale. I understand that my $25 fee covers the first 200 items using the Valet Tagging service, and I will be charged a $5 supply fee for each group of 50 items thereafter.

I understand JBF Houston Northeast will sell the items I am consigning for the price listed on the barcode tags as created by the Valet Tagger. I understand that the price sold will be controlled by the printed tag attached to the item & not any subsequent changes online.

I understand all my items will be marked to reduce, items will be sold at 50% off at the Half Price Presale.

I understand if my item is marked donate, it will be available for sale as a fundraiser benefiting our charity partner during the last hour of our sale on Saturday (to charity fundraiser ticket holders only).

I verify that no item I am consigning is the subject of any current, pending or threatened recall notice according to the Consumer Products Safety Commission.

Each item is clean, in good operating condition & is not defective, broken or damaged in any way. If any item is purchased and returned because it is defective, is missing parts or does not work, I will not be paid any amount for the sale of that item.

I understand that all remaining items are donated after Seller Pick Up ends.

I understand that by appearing in a public venue as a shopper or consignor, JBF has my permission to use my image in any JBF publicity avenue they choose. I may verbally request to not be photographed at the Sale.

I understand that the email address listed in my JBF Profile will be used to issue my consignor payment unless I request a paper check sent via US mail.

I consent to receive SMS messages (including text messages), and telephone calls from us, our agents, representatives, affiliates, or anyone communicating on our behalf at the specific number(s) you have provided to us, with service-related information, questions about your use of the Services, and marketing information. You certify, warrant, and represent that the telephone number you have provided to us is your contact number and not someone else’s. You represent that you are permitted to receive calls and text messages at the telephone number you have provided to us. You agree to promptly alert us whenever you stop using a telephone number. Standard message and data rates may apply to all SMS messages (including text messages). We may modify or terminate our SMS messaging services from time to time, for any reason, and without notice, including the right to terminate SMS messaging with or without notice, without liability to you.

Representations and Warranties:
I am the owner of and have carefully inspected the items that I am consigning. I am aware of the requirements established by the Consumer Product Safety Improvement Act of 2008 (CPSIA) and related rules and regulations adopted and promulgated by the United States Consumer Produce Safety Commission (CPSC). I represent and warrant that the items that I am consigning do not violate the CPSIA or any related rules or regulations adopted by the CPSC regarding the resale of banned, hazardous or harmful items or products. Specifically, I represent and warrant that the items that I am consigning:

1. Have not been recalled by the CPSC;

2. Do not contain an amount of lead that is prohibited by the CPSIA or the CPSC;

3. Do not contain a concentration of phthalates that is prohibited by the CPSIA or the CPSC;

4. Do not contain flammable materials that are prohibited by the CPSIA or the CPSC;

5. Do not consist of small parts or produce small parts when broken, which could produce a choking hazard;

6. Do not otherwise present a substantial product hazard that has been prohibited by the CPSIA or the CPSC.

I agree to waive relinquish, discharge, release, and covenant not to sue JBF Houston (“JBF Franchisee”) and Just Between Friends Franchise Systems, Inc. (“JBF Franchisor”) or any of either entity’s members, officers, directors, agents, employees, and Team Members for any and all claims of injury, damage, or loss that any purchaser of the items I am consigning may have or that may accrue to any purchaser of the items arising out of, connected with, or in any way associated with such consigned items.

I agree to defend, indemnify and hold harmless JBF Franchisee and JBF Franchisor, and any of either entity’s members, officers, directors, agents, employees, and Team Members from and against, without limitation, any and all claims, loss, damages, forfeitures, penalties, liability, actions, suits, costs and attorney fees arising from or related to the items I am consigning, including, but not limited to, any and all claims, loss, damages, forfeitures, penalties, liability, actions, suits, costs and attorney fees arising from or related to violations of the CPSIA or any related rules and regulations adopted by the CPSC, including but not limited to the warranties indicated above.

By signing below, I confirm that: (1) I have read and fully understand this Consignor Agreement and Liability Waiver, including the Representations and Warranties stated above; (2) I agree to and warrant as stated above; and (3) no one has made to me representations, statements, or inducements that change or modify anything written in this Consignor Agreement and Liability Waiver.
